Privacy Policy & Terms and Conditions

How TheDigiTwinkle collects and protects your information, and the terms that guide our work together.

Part One

Privacy Policy

I.

Introduction

TheDigiTwinkle ("we", "us", "our", "the studio") is a design and content studio founded by Twinkle, based in New York and working with clients worldwide. This Privacy Policy explains what information we collect through thetwinkledigi.com and while working on your project, why we collect it, and the choices you have.

By using this website or engaging our services, you agree to the practices described here. If you don't agree, please don't submit personal information through the site.

II.

Information we collect

We collect information in two ways: what you give us directly, and what your browser shares automatically.

  • Information you provide — your name, email address, and project details when you fill in the contact form, email us, or brief us on a project.
  • Project materials — brand assets, references, copy, images or other files you send us so we can design, build or produce your project.
  • Payment details — billing information needed to process advances and final payments, handled by our payment processor rather than stored on our servers.
  • Technical information — IP address, browser type, device type, and pages visited, collected automatically through standard website analytics.
III.

How we use your information

We use the information collected to:

  • Respond to enquiries and discuss your project;
  • Plan, design, and deliver the work you've commissioned;
  • Send project updates, drafts, invoices and delivery files;
  • Improve the website and understand how visitors find and use it;
  • Meet legal, accounting, or tax obligations.
We do not sell, rent, or trade your personal information to third parties for marketing purposes.
IV.

Cookies & analytics

Our website may use cookies and similar technologies (such as Google Analytics) to understand how visitors use the site — for example, which pages are most popular. You can disable cookies through your browser settings at any time; the site will still function, though some features may behave differently.

V.

Third-party services

We may share information with trusted third parties strictly to run the studio and deliver your project, including:

  • Website hosting and form providers (to run thetwinkledigi.com and process enquiries);
  • Payment processors (to handle advances and balances);
  • Email and file-sharing tools (to send drafts, proofs and final deliverables).

These providers only receive the information needed to perform their function and are not permitted to use it for their own purposes.

VI.

Data security

We take reasonable technical and organisational precautions to keep your information and project files safe — including limiting access, using reputable third-party tools, and storing files securely. No method of transmission or storage is 100% secure, so we can't guarantee absolute security, but we work to protect your data at every step.

VII.

Your rights

Depending on where you're based, you may have the right to:

  • Access the personal information we hold about you;
  • Ask us to correct or update inaccurate information;
  • Ask us to delete your information, once any active project and legal obligations are complete;
  • Withdraw consent to marketing communications at any time.

To exercise any of these rights, simply get in touch using the contact details on the site.

VIII.

Children's privacy

Our services are intended for individuals and businesses old enough to enter a service agreement. We do not knowingly collect information from children, and any such data discovered will be deleted promptly.

IX.

Changes to this policy

We may update this Privacy Policy from time to time as the studio grows or regulations change. Any updates will be reflected on this page — we encourage you to check back occasionally.

Part Two

Terms & Conditions

I.

Agreement to terms

These Terms and Conditions govern your use of thetwinkledigi.com and any design, content, or development services provided by TheDigiTwinkle. By browsing this site, submitting an enquiry, or commissioning a project, you agree to be bound by these terms.

II.

Services

TheDigiTwinkle offers design and content services including but not limited to graphic design, UI/UX design, web development, app development, and related creative work. The specific scope, deliverables, timeline, and price for a project are agreed with each client individually before work begins.

III.

Project process & approvals

Projects typically move through a brief, initial directions, feedback rounds, and final delivery. Clients are responsible for providing timely, clear feedback and approvals at each stage. Delays in feedback may affect the overall project timeline.

IV.

Fees & payment

Pricing, deposit requirements, and payment schedules are set out in the individual project agreement or invoice. Unless otherwise agreed:

  • An advance payment may be required before work begins;
  • Final files are released upon receipt of the remaining balance;
  • Late payments may delay delivery or ongoing work.
V.

Revisions

Each project includes an agreed number of revision rounds, specified at the time of booking. Additional revisions beyond that scope may incur extra charges, agreed in advance with the client.

VI.

Intellectual property

Upon full payment, ownership of the final agreed deliverables transfers to the client, unless otherwise stated in the project agreement. TheDigiTwinkle retains the right to:

  • Showcase completed work in a portfolio, on social media, or in marketing materials, unless the client requests confidentiality;
  • Retain working files, drafts, and unused concepts.

Clients must have the right to use any materials (images, copy, logos, etc.) they provide for a project; TheDigiTwinkle is not liable for third-party rights issues arising from client-supplied materials.

VII.

Cancellations

Either party may cancel a project with written notice. In the event of cancellation, any work completed up to that point will be invoiced, and advance payments already made are generally non-refundable, unless otherwise agreed.

VIII.

Limitation of liability

TheDigiTwinkle will perform services with reasonable skill and care, but does not guarantee specific business outcomes (such as sales, traffic, or engagement) resulting from delivered work. TheDigiTwinkle is not liable for indirect or consequential losses arising from the use of delivered materials.

IX.

Website use

All content on thetwinkledigi.com — including text, graphics, and logos — is the property of TheDigiTwinkle unless otherwise credited, and may not be copied or reused without permission.

X.

Changes to these terms

These Terms and Conditions may be updated from time to time as the studio grows or as circumstances require. Continued use of the site or services after changes are posted constitutes acceptance of the updated terms.
